Man files lawsuit to get his guns back


ELYRIA — A Lorain man is suing the Oberlin Police Department for the return of two guns seized by officers after his arrest on a domestic violence charge in 2010.

Joseph Wysocki later pleaded no contest to criminal mischief involving a family member, a charge for which he remains on probation through Oberlin Municipal Court.

But according to Wysocki’s lawsuit, filed Wednesday in Lorain County Common Pleas Court, Oberlin police have failed to return the guns, despite his requests that they do so.

Wysocki had requested that the guns be returned, and prosecutors objected, according to court records. Oberlin Municipal Court Judge Thomas Januzzi ruled that he didn’t have the power to order their return under the law.

He suggested in his decision that Wysocki file a lawsuit for the weapons’ return.
