ELYRIA — Convicted sex offender William Tyrone Montgomery will return to court next month for a hearing on his request for early release from his 1½-year prison sentence.
Montgomery, 52, filed the request last month. This week, Lorain County Common Pleas Judge Mark Betleski set a hearing on the matter, according to court records.
Prosecutors are opposing letting Montgomery, a former deputy clerk for county Clerk of Courts Ron Nabakowski, out of prison before he’s served his full sentence. Montgomery began serving his sentence in April.
Montgomery pleaded guilty in March to multiple counts of gross sexual imposition of an underage girl that he began molesting when she was 8 years old in 1983. The sexual abuse spanned roughly a decade, according to court documents.
The victim, now an adult who had urged Betleski to imprison Montgomery, contacted police about the sexual abuse years after it had stopped, and Montgomery was indicted in August 2013, just weeks before the statute of limitations would have expired.
Defense attorney Jack Bradley wrote in his court filing requesting what is known under old Ohio law as “shock probation” that his client accepted responsibility for his actions even before he was incarcerated.
“Since Mr. Montgomery’s incarceration, he has had time to reflect upon his crimes,” Bradley wrote. “As a profoundly spiritual man, Mr. Montgomery cannot express how deeply he regrets his crimes and the suffering they have caused. Every day he prays that his victim is recovering from his egregious actions, but he does not seek forgiveness — rather he prays the victim can find a way to alleviate the pain he has caused.”
Bradley wrote that Montgomery is still a sex offender and must register for 10 years.
Assistant County Prosecutor Chris Pierre wrote that Montgomery hasn’t served nearly enough time for his crimes.
“The state submits that the defendant’s sentence of one and a half years is very little time when compared to the 10 years that the named victim was sexually abused at his hands,” Pierre wrote. “The defendant began sexually abusing the named victim when she was 8 years old and continued to kiss, fondle and engage in oral and anal sex with her until she was 18 years old. The defendant’s abuse has had lasting and devastating consequences in the named victim’s life that she continues to deal with on a daily basis.”
