Man pleads guilty to assault, discharging firearm charges


ELYRIA -- An Elyria man who shot his girlfriend's estranged husband in the stomach on Dec. 23, 2012, pleaded guilty Monday to charges of negligent assault and discharging a firearm near a habitation.

Tommy Fluker Jr., 36, was immediately sentenced to a 90-day suspended jail sentence by Lorain County Common Pleas Judge Mark Betleski.

Fluker told police he was with his girlfriend, Arrianna Horton, when they saw a light outside his Ironwood Court home and recognized the voice of her husband, Hamp Horton, who was barred by court order from having contact with either his wife or Fluker.

Police reported that Fluker grabbed a .22-caliber pistol and fired several shots through the wall of his home at Hamp Horton before going outside and firing at Horton again as he got into a vehicle. After Horton had left, Fluker called police.

Horton, 42, initially denied being at Fluker's house. He is being sought on an arrest warrant for failing to appear in Elyria Municipal Court to answer a charge he violated a protection order on the night of the shooting by going to Ironwood Court.
