Avon woman faces jail, fines for stalking order

AVON LAKE — The Avon woman who obtained a civil stalking protection order against an Avon Lake Municipal Court bailiff has a new legal problem about which to worry.

Avon Lake Judge Darrel Bilancini has ordered Cynthia Mingus to appear before him today to explain why he shouldn’t hold her in contempt of court for getting the protection order against Bailiff Mark Hagedorn earlier this month.

Bilancini said it appears Mingus got the protection order in an effort to keep Hagedorn from enforcing an eviction order the judge had filed against Mingus in regard to her apartment in the Village at Avon complex.

Mingus also failed to leave the apartment by the 6 p.m. deadline on July 7 that Bilancini included in his order, which was issued because she’d fail to pay the rent.

“It’s primarily the effort to block the court’s bailiff from following through with the order that the court made with regard to the order of eviction,” Bilancini said.

If she can’t offer a satisfactory explanation, Bilancini said he could fine Mingus up to $250 or send her to jail for 30 days.

“From my perspective, it’s appropriate that this defendant be brought before the court to explain what happened and why it happened,” he said.

Mingus dropped her request for the protection order against Hagedorn the day before it was scheduled to have gone for a full hearing before Lorain County Common Pleas Magistrate Michelle Pena. Mingus, who cited “bad press” as part of her reasoning for dropping the request, had accused Hagedorn of threatening and harassing her.

But Hagedorn has said he was only trying to make sure that Mingus left the apartment and when she finally moved out on July 8, he even helped her carry her bags to her car.

Mingus has a string of other legal and financial problems in her past and is presently facing criminal charges for passing bad checks in Lorain and Cuyahoga counties.

Her court-appointed attorney in the Lorain County case, Anthony Rich, declined to comment on the contempt charge because he doesn’t represent Mingus in that case.

Mingus, who could not be reached for comment, is also in the final months of a pregnancy, according to court records.

Well, you’re not gonna get the money to pay the fine…send her to jail, maybe she’ll learn her lesson…
